This comprehensive report examines the impact of Morocco’s data exclusivity provisions, introduced as part of the US-Morocco Free Trade Agreement (FTA), on the accessibility of affordable generic medicines. The study provides a detailed analysis of how these provisions, which extend market protection by restricting competition, can delay the entry of generic alternatives even in cases where no patent protection is in place.
By highlighting the significant barriers to access posed by data exclusivity rules, the report aims to shed light on the urgent need for policy reforms. It presents comparative case studies from countries such as Chile and Jordan, where similar provisions were successfully reformed to enhance access to essential medicines. The report encourages Moroccan policymakers to consider adopting similar reforms to address the growing health needs of its population and improve the availability of life-saving treatments.
